Portrait + Branding Session
The Agreement between the client and Photographer is as follows:
The Client agrees to the sum set out in the contract and formal invoice.
Monies are owed at the time of booking and are considered non-refundable. The session is not confirmed until the booking fee is paid in full. The date may become unavailable should another client fulfill their obligations before said client.
The Brand session length will be outlined in the contract, with each additional 15 minutes costing the Client $75.
In return, the Client will receive 35+ high-resolution digital prints per hour shot delivered to the Client via email (this session does not include physical prints).
It is the client’s responsibility to download the digital prints to the device of their choice within 7 business days of being received. The photographer is not responsible for the images once they are downloaded, and it is up to the client to store the images appropriately.
Payments + Refunds
A non-refundable session fee is required to secure the date and time of your session. There will be one (1) opportunity to reschedule the session, in which the client must contact the photographer a minimum of 48 hours prior to the session and the payment schedule must have been respected (the location may change at the Photographer's discretion).
If the full payment is not received prior to the session, the session is considered cancelled. There are no refunds.
This contract represents the entire understanding of the requirements, schedule, and payment terms for the Single Brand Session.
If there are any legal disputes or actions resulting in a formal legal proceeding related to this contract, such actions will take place in Winnipeg, Manitoba, Canada, under Winnipeg, Manitoba, Canada law.
Clients accept sole financial responsibility for any legal fees or fee-related costs incurred by the Photographer in enforcing the term of this Mimosa contract.
Privacy
All high-resolution images will be posted to an online gallery and protected by a private link, only to be given to the client(s) named on the contract.
The Photographer cannot be held liable if your images are circulated online against your will, if you made the decision to post the images provided to you online or display them publicly.
Copyright
The Photographer owns the rights and intellectual property to these images. The Client is not allowed to sell these images, monetize them for commercial use, monetize them in any way or use them in any photography contests. If the clients would like to license the image, the client and photographer must come to a financial agreement. If the images are being published, the photographer must be credited in print alongside the image. Please refrain from manipulating/editing these images.
Liability
The Photographer owns all the photography gear. Misuse or damage to any property of the Photographer or studio is unacceptable and falls at the expense of the Client. The Client will be required to replace or compensate the Photographer for any damage done to the studio, camera gear, or lighting equipment.
If the Photographer is unable to fulfill the session or goods outlined in this contract for any reason, the Photographer agrees to refund all fees paid by the Client, minus any expenses incurred. The sole remedy for any actions or claims resulting from the Photographer's inability to deliver the goods and services listed in this contract shall be limited to a refund of monies paid by Client to the Photographer.
Digital Retouching
The Photographer will digitally enhance the images using Adobe Lightroom + Adobe Photoshop. Enhancing is defined as spot removal, blemish removal, teeth whitening, enhancement of the eyes, adjustment of the temperature/colouring and adding an artistic flair at the Photographer's discretion. If the client requires additional retouching outside these enhancements, there will be a fee of $100 an hour associated with these enhancements.
Tardiness & Cancellations
If the Client is inclined to cancel a scheduled session, they are entitled to one rebooking free of charge IF they have contacted The Photographer 48 hours prior to the session. The Client is to provide notice by contacting the Photographer via email (info@reannakhan.com).
Should the Client cancel a second time, a $75 fee will be added to the session's invoice.
Should the Client cancel the session outside these parameters, they are no longer entitled to the booked session and the initial booking fee and session rate are forfeited.
Should the Client be tardy for their session, it will cut into the allotted time for the shoot. The session will not be extended nor will the Client be refunded. The Photographer may extend the session at their discretion. Every 15 minutes, the Photographer is required to stay outside the session time frame will result in a $75 fee.
The image gallery will not be delivered until the full invoice and any additional fees are paid.
